JUDGE ASKING FOR UPDATE PRIOR TO RESENTENCING

Blair County Judge Daniel J. Milliron is asking for a new or updated presentence investigation to be completed before he resentences Kenneth Jon Piner Sr. of Altoona, who is currently serving a 36- to 72-year sentence for his part in a Baltimore-to-Altoona drug ring. Piner is now 60 years old, and based on a 2013 US Supreme Court ruling that said Pennsylvania’s mandatory sentencing procegures are unconstitutiona, he is now entitled to a new sentence . That resentencing was originally scheduled for Tuesday, but Judge Milliron said that he was able to find no presentence investigation with updated information. Piner’s current sentence was handed down back in June 2013, and he is now being held in the State Correctional Institution at Rockview. The judge said he now expects the presentence investigation can be completed in about 60 days, and the sentencing will then be scheduled after that.
