After initially being dismissed back in February, charges including burglary have been reinstated against a Duncansville man. Original charges faced by 32 year old Brian Hoover were dismissed by Blair County Judge Timothy Sullivan because evidence produced at a hearing showed that he was part owner of the property… along with his former girlfriend… on July 1, 2020, when the break-in occurred. In February, Judge Sullivan ruled that Hoover had a legal interest in the property and therefore, could freely remove any fixtures he desired. He dismissed charges of burglary, criminal trespass, criminal mischief, theft by unlawful taking and receiving stolen property. But after a document related to ownership came to light after that decision, the Blair County DA’s office filed a motion to reinstate the charges. In a separate deed, Hoover had apparently given up his ownership of the property. In an updated opinion issued late last week based on the newly discovered evidence, Judge Sullivan ruled the prosecution had met its burden of showing probable cause that a burglary had occurred, and he reinstated all of the charges.
